# GENERAL TERMS AND CONDITIONS OF RENTAL

## Article 2 — Scope
These General Terms and Conditions of Rental (hereinafter "Terms") govern all vehicle rental services provided by BORA CARS, including the provision of vehicles with or without a driver, for short-term (events, weddings, weekends) or long-term use.
Any booking implies the full and unconditional acceptance of these Terms by the client.

## Article 3 — Eligibility Requirements
To rent a vehicle from BORA CARS, the client must:
- Be at least 21 years of age on the date of vehicle collection;
- Hold a valid driving license for at least 3 years (French, European, and international driving licenses are accepted);
- Provide all mandatory documents listed in Article 4.
BORA CARS reserves the right to decline any booking without obligation to justify its decision.

## Article 4 — Required Documents
The client must provide the following documents prior to vehicle collection:
1. A valid driving license (in the name of the declared driver);
2. A valid identity document (national ID card or passport);
3. Proof of address dated within the last 3 months, in the driver's name.
BORA CARS reserves the right to request any additional documentation deemed necessary to verify the client's identity (secondary ID, insurance certificate, claims history, etc.).
Should documents be incomplete, non-compliant, or not submitted within the required timeframe, BORA CARS reserves the right to cancel the booking. The deposit paid shall be retained.

## Article 5 — Booking Process
### 5.1 — Booking Request
The client submits a booking request through BORA CARS' official communication channels (website, social media, email). A vehicle may be reserved up to 1 year in advance and no later than 1 hour before departure, subject to availability and acceptance by BORA CARS.
### 5.2 — Deposit and Confirmation
A deposit is required to confirm any booking. The deposit amount varies per booking and is capped at 30% of the total rental price. Until the deposit has been received by BORA CARS, the booking is not confirmed and the vehicle is not guaranteed.
### 5.3 — Booking Confirmation
Once the deposit has been received, BORA CARS will provide the client with a booking confirmation detailing:
- The selected vehicle;
- The date and time of collection and return;
- The meeting point;
- The total amount, deposit paid, and remaining balance;
- The security deposit amount.

## Article 6 — Pricing and Payment Terms
### 6.1 — Pricing
Prices are communicated to the client at the time of quotation. They include the provision of the vehicle, a defined mileage allowance (variable depending on the vehicle and rental duration), and the specific conditions applicable to each booking.
Any excess mileage will be subject to an additional charge. The per-kilometre rate will be specified in the individual rental agreement.
### 6.2 — Payment Terms
- **Deposit**: payable upon booking (up to 30% of the total amount);
- **Balance**: payable no later than vehicle collection;
- **Security deposit**: payable at vehicle collection (amount varies per vehicle and is specified in the rental agreement).
Accepted payment methods are communicated to the client at the time of booking.
### 6.3 — Fuel
The vehicle is provided with a fuel level recorded on the outbound condition report. The client undertakes to return the vehicle with the same fuel level. Any shortfall will result in an additional charge.

## Article 7 — Security Deposit
A security deposit is required for every rental. The amount varies according to the vehicle rented and is specified in the individual rental agreement.
The security deposit may be partially or fully retained in the following cases (non-exhaustive list):
- Damage to the vehicle (scratches, scuffs, bodywork damage, interior deterioration);
- Tobacco smell or cigarette traces inside the vehicle;
- Traffic violations incurred during the rental period;
- Dangerous or reckless driving;
- Excess mileage beyond the agreed allowance;
- Late return without prior notice;
- Fuel level not matching the outbound condition report;
- Any breach of the obligations set out in these Terms.
BORA CARS undertakes to refund the full security deposit if the vehicle is returned in a condition consistent with the outbound condition report and in compliance with the rental agreement.
The security deposit shall be refunded within a minimum of 7 business days following vehicle return. This period may be extended depending on the verifications required (damage assessment, receipt of repair estimates from a professional, verification of traffic violations). The client shall be informed accordingly.

## Article 8 — Cancellation Policy
### 8.1 — Cancellation by the Client

All cancellations must be submitted in writing (email to contact@boracars.com).
### 8.2 — Cancellation by BORA CARS
Should BORA CARS be unable to provide the reserved vehicle (mechanical failure, accident, tyre damage, severe weather conditions, or any event endangering the safety of the delivery driver or compromising the vehicle's condition), BORA CARS undertakes to:
- Notify the client as soon as possible;
- Offer a replacement vehicle of equivalent or superior category, subject to availability;
- In the absence of a suitable replacement, issue a full refund of all sums paid.
### 8.3 — Force Majeure
In cases of force majeure (natural disaster, hospitalisation, bereavement — upon presentation of supporting documentation), the client shall be entitled to a full refund of all sums paid, regardless of the cancellation notice period.

## Article 9 — Client Obligations
The client undertakes to:
- Use the vehicle responsibly, in compliance with traffic laws and applicable regulations;
- Not sublease, lend, or make the vehicle available to any undeclared third party;
- Not smoke inside the vehicle;
- Not use the vehicle for competitions, racing, rallies, or any unlawful activity;
- Not transport dangerous, illegal, or potentially damaging goods;
- Return the vehicle at the agreed location, date, and time specified in the rental agreement;
- Immediately report any accident, breakdown, theft, or incident to BORA CARS.
Any breach of these obligations shall result in additional charges and/or partial or full retention of the security deposit.

## Article 10 — Vehicle Condition and Liability
### 10.1 — Condition Report
A joint condition report is carried out at vehicle collection and return, in the presence of the client and a BORA CARS representative. Any damage not recorded on the outbound condition report shall be presumed attributable to the client.
### 10.2 — Damage
The client is liable for all damage caused to the vehicle during the rental period. In the event of an incident, the client undertakes to:
- Move the vehicle only if required for safety reasons;
- Complete an accident report form;
- Notify BORA CARS immediately;
- Submit all incident-related documents within 48 hours.
### 10.3 — Theft
In the event of vehicle theft, the client must immediately file a report with the relevant authorities and provide a copy of the police report to BORA CARS within 24 hours.

## Article 11 — Vehicle Return
### 11.1 — Return Conditions
The vehicle must be returned at the date, time, and location agreed in the rental contract, in a condition consistent with the outbound condition report (interior cleanliness, fuel level, no damage).
### 11.2 — Late Return
Any unauthorised late return shall be charged at a rate of **€50 per hour** (or part thereof). After 4 hours of delay without prior communication, BORA CARS reserves the right to report the vehicle as unreturned and to take appropriate action.

## Article 12 — Insurance
The rented vehicle is covered by an insurance policy. The applicable guarantees and excess amounts are specified in the individual rental agreement. The client is informed of the applicable excess and shall remain liable for it in the event of a claim.

## Article 13 — Personal Data Protection
Personal data collected in connection with the booking is processed in accordance with the GDPR (EU 2016/679) and the French Data Protection Act (Loi Informatique et Libertés). Data is used exclusively for rental management purposes and is not shared with third parties without the client's consent, except where required by law. The client may exercise their rights of access, rectification, erasure, and portability by writing to contact@boracars.com.

## Article 14 — Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution. Failing that, any dispute shall be submitted to the competent courts within the jurisdiction of BORA CARS' registered office (Tribunal judiciaire de Besançon).

## Article 15 — Acceptance of Terms
The client acknowledges having read and understood these General Terms and Conditions of Rental and accepts them without reservation at the time of confirming their booking.
